Charter Rules and Policies

1. Vessel Decoration
If the client wishes to decorate the vessel, access may be granted a few hours before the event only if availability and logistics permit. Otherwise, the time dedicated to decoration will be deducted from the contracted charter time.

A maximum of three (3) people is authorized to perform the decoration. Access for additional people will not be permitted under any circumstances.

On vessels such as the Catamaran 54' and Catamaran 44', the use of balloons in exterior areas is strictly prohibited.

It is the client's sole responsibility to communicate these conditions to their decoration provider.

2. Private DJ
If the client wishes to bring a DJ, they must ensure the DJ provides their own:

Speakers, extension cords, and power strips.

All necessary equipment. Note: The vessels only allow audio connection via Bluetooth.

Vessels such as the Yacht 55' Hatters, Yacht 47' Rapport, Yacht 47' King Fish, and Yacht 35' Cabo do not include a power generator. If a generator is required, an additional fee must be paid.

3. Marina Dress Code and Conduct
All passengers must be properly dressed during both embarkation and disembarkation.

The exclusive use of swimwear is not permitted within the marina, nor is the consumption of alcohol or disorderly conduct during embarkation. Non-compliance may result in fines imposed by the marina.

Once on board, alcohol consumption is permitted.

4. Footwear Policy
The use of footwear is prohibited on board. All passengers must leave their shoes in a designated box upon entering.

5. Bathroom Usage
It is strictly forbidden to flush toilet paper, tampons, or sanitary pads down the toilet, as this causes damage to the pumping system.

The client will assume repair costs, which amount to $450, in case of non-compliance.

6. Utensils and Catering
The client is responsible for bringing exclusively plastic cups, plates, and cutlery, as well as shatterproof beverage containers to avoid accidents.

This provision does not apply if the client has contracted our catering service.

7. Prohibited Items and Behavior
The following are strictly prohibited:

Carrying weapons of any kind.

Use of fireworks.

Smoking on board.

Bringing musicians (singers, mariachis, etc.) to the marina before embarkation. If this occurs, the client will be responsible for any fines imposed by the marina.

8. Food Preparation on Board
Only foods that can be prepared on the vessel's BBQ (e.g., meats, sausages, corn on the cob) are allowed.

The use of the BBQ is exclusive to the chef or authorized personnel.

If bringing food that cannot be prepared on the BBQ, it must arrive pre-cooked.

For more elaborate options, we offer full catering services and side dishes for an additional cost.

9. Customer Service During the Charter
If any issue or requirement arises during the activity, the client must communicate exclusively with their sales advisor or the person who assisted them during embarkation.

Complaints directed at the captain, deckhand, or chef will not be accepted.

10. Island Disembarkation (Taboga, Contadora, etc.)
When visiting islands, if the client wishes to go ashore, they must inform the captain.

Depending on the vessel, a dinghy (auxiliary boat) may be used if available and not reserved for emergencies.

If the dinghy is not used, the captain or deckhand will arrange an external "panga" (water taxi).

The cost of the panga transfer ($2-$3 per person, round trip) shall be paid directly by the passengers to the service provider.

11. Use of Floats and Recreational Items
Inflatables and other recreational items included as a courtesy are subject to availability and proper functioning at the time of the event.

The company is not responsible for failures, punctures, or deterioration of the floats that may occur on the day of service, as these are unpredictable events beyond our control.

The client accepts that the price paid corresponds exclusively to the vessel rental; therefore, the unavailability of floats will not result in refunds, discounts, or compensation.

12. Scheduling and Timelines
The schedules established for each destination include the total travel time. For example, an 8-hour charter includes both the navigation time to the destination and the return trip to the marina.

Departure times are approximate, as they are subject to marina logistics and operational controls, which may cause slight delays. No claims will be accepted for delays originating from causes outside the LESSOR'S control.

13. Acceptance of Rules and General Policies
By signing the contract (sent or received in person), the client declares they have read, understood, and accepted in their entirety the general charter rules and all operational and behavioral policies detailed above. Furthermore, the client confirms having received and accepted any additional policies sent via official communication channels (WhatsApp or other authorized media).

The signing of the contract implies the express and irrevocable acceptance of all conditions set forth herein, releasing the company from any liability arising from the client's or their guests' ignorance or breach of these rules.

Private Charter Cancellation Policies

GENERAL CANCELLATION POLICY:

Due to causes attributable to the LESSOR

If the service cannot be provided, the following refund or rescheduling policies shall apply:

In the event the vessel becomes unavailable due to damage, mechanical failure, or any matter under the responsibility of the LESSOR that prevents departure, the LESSEE may choose one of the following options:

a) Reschedule the service to a new date of their convenience, subject to availability;
b) Substitute the vessel with another available vessel; or
c) Request a full refund of the amount paid.

In the event of weather conditions that prevent departure due to an official advisory issued by SINAPROC (National Civil Protection System of Panama), the service may be rescheduled to a new date subject to availability. No refund shall apply in such cases, as they constitute force majeure beyond the control of the LESSOR.

Due to causes attributable to the LESSEE (including force majeure reasons)

With a minimum prior notice of three (3) weeks before departure to the LESSOR, the LESSEE shall have the right to RESCHEDULE (NOT TO RECEIVE A REFUND) the service to a new date of their convenience, subject to vessel availability.

The LESSEE shall be entitled to request a full refund only if the cancellation is made within the first seven (7) days following the date of booking, provided that the charter is scheduled for a date later than those seven (7) days.

If the charter is scheduled within five (5) days from the date of booking, no refund shall apply; only rescheduling to another available date shall be permitted, subject to confirmation by the LESSOR.

Cancellation Policy – Catamaran 47' and Catamaran 54' Aquila

If the client cancels the service at least seven (7) days prior to the charter date, a penalty of fifty percent (50%) of the amount paid shall apply.

If the cancellation is made less than seventy-two (72) hours prior to the charter date, no refund shall apply, as such cancellation limits the LESSOR’s ability to offer the date to another client.

Rescheduling

If the Client requests to reschedule the charter date less than seventy-two (72) hours prior to departure, an additional charge of twenty-five percent (25%) of the total rental value shall apply.

Rescheduling shall be subject to vessel availability and the rates in effect for the newly requested period. Original rates are not guaranteed for rescheduled dates.

Cancellation Policy – Yacht 35' Cabo, Yacht 47' Rapport, Yacht 47' King Fish, Yacht 55' Hatteras, Catamaran 37', and 30' Speedboat

All cancellations must be made at least thirty (30) days prior to the tour date to receive a 100% refund of the amount paid to date.

If cancellation is made between twenty-nine (29) and fifteen (15) days prior to the tour date, the service may be rescheduled, but no refund shall apply.

If cancellation is made fifteen (15) days or less prior to the tour date, all amounts paid up to that time shall be forfeited.
